1. Definitions

“The Photographer” refers to and represents Rachel Collins Photography, 148 Wessex Close, Chard, Somerset, TA20 2JG. “The Client” means any person, body of persons, firm or Company with whom the Photographer enters into a contract for the sale of goods or provision of services by the Photographer.

2. Copyright

Rachel Collins Photography own and retain the copyright to all the images we capture, unless at the time of booking a release is negotiated.

The images captured are protected in law and by purchasing the image either online or at an event you are purchasing the right to the photo, not the copyright and therefore have no rights to reproduce the photo in or on any medium. This includes, but is not restricted to scanning, copying, republishing, advertising, uploading, transmitting or displaying the image. Should you wish to undertake any re-use of the image in any way or on any medium then written permission must be obtained from Rachel Collins Photography.

3. Acceptance of Terms and Conditions

All contracts and transactions between the Photographer and the Client whether made orally or in writing are subject to these terms and conditions which shall be deemed to be incorporated into any contract between the Photographer and all or any of its Clients

4. Cancellation Fees / Overruns

If a booking is cancelled by the Client where a fee has been agreed within one working day of the starting time, the Photographer reserves the right to charge his full fee for the assignment. If a booking is cancelled within two working days of the starting time, the Photographer may charge 50% of his fee.

For cancellations/postponements due to weather conditions, the Photographer reserves the right to charge his full fee and expenses due to weather conditions on location. In such instances, the Photographer may charge in full for his expenses (e.g. including but not limited to; hire of specialist equipment, vehicles etc), that he may have incurred prior or during the assignment taking place.

5. Privacy

Rachel Collins Photography is committed to protecting your privacy. Any information gathered during your use of any of our services will not be sold, traded or rented to any third parties. All information supplied to us while completing any form on this site will be protected by secure server software as far as is reasonably practicable. By using this website you accept these terms.

Required Information

To fulfil any order placed with Rachel Collins Photography the following information will be required – Name, Address, Address of recipient (if different) e-mail address, Contact telephone number, payment details (CC number, start and expiry dates, issue no and security no) We may also contact you via e-mail no more than twice a year to inform you of changes to the site and offers / new products.

6. Payment Methods

We currently only accept GBP £ as a currency

6a. Refund Policy

Rachel Collins Photography offer a 100% satisfaction guarantee on all images and products supplied. In the event of damage that has occurred during delivery please inform us within 24hours either by phone or e-mail and we will arrange a replacement.

Should you not be happy with the image in any way we offer a full refund so long as we are notified within 28 days of the order being placed, we will then refund in full within 7 days

7. Our Website

All material contained on this and all other websites owned and operated by Rachel Collins Photography are protected by copyright laws and copyscape software. Any violation of this copyright will be reported to the appropriate authorities and ISP’s. No part of this website including all images, information, layout and feel of the site maybe copied or republished in any form. Any link to any page or image must first be approved by ultimate images. All links are monitored on a daily basis and any unauthorised links will be investigated.

8. Outbound Links

Any links on this site do not represent an endorsement of the site or product referenced by the link. The following of any link is at the risk of the user and Rachel Collins Photography accept no liability for the content of third party sites.

9. Conduct

The Client shall be responsible for the behavior of any persons accompanying them to an assignment. The Photographer reserves the right to terminate any assignment without notice if he deems the Clients behaviour to be unruly or unsafe. In such instances, the Photographer reserves the right to charge his full fees and expenses as described in clause 4 of these Terms and Conditions. The Client will fully reimburse the Photographer or his agents for any loss/damage they cause to property or equipment.

11. Delivery of Products and Services

The supply of products and services are provided by the Photographer on a best endeavors basis. The Photographer will not be liable for delays that are beyond his reasonable control. The Photographer shall use reasonable endeavors to meet agreed deadlines where applicable. The Photographer shall not be liable for any delays in meeting any of his obligations which were due to causes beyond his reasonable control including but not limited to; postage/courier/lab delays, war/acts of terrorism, riots, government legislation, industrial action, adverse weather conditions, acts of God, floods, fire, loss or damage in transit etc.

12. Prices & Terms

The Photographer reserves the right to amend both Prices and these Terms and Conditions without prior notice.

13. Rush Services

The Photographer reserves the right make an additional charge should the Client request a rush service. This service is subject to availability and cannot be guaranteed.

14. Images/Data Supplied in Electronic Format

For all images/data supplied to the Client in electronic format (including but not limited to electronic mail, CD’s/DVD’s/USB’s etc), The Photographer will endeavor to ensure that the data sent is not corrupt and is virus-free. The Photographer cannot be held responsible for any damage, disruption and/or loss of any kind that the said media may cause to the Clients computer or data. The Client agrees to take similar steps to ensure that data sent to the Photographer is not corrupt and/or virus-free. Due to the nature of the delivery method no refunds can be given for images supplied in a digital format

15. Law

This Agreement shall be subject to and constructed according to English Law and the parties agree to accept the exclusive direction of the Courts of England

16. Cropping

All images are cropped as the cameras native ratio is 3:2, so an 8×6 print will loose 1inch from the edges, and a 10×8 would loose 2 inches from the side. All images are therefore shot with this in mind, and will be cropped as we feel best. Should you request a specific crop i.e centralise horse – then please be aware that we will crop to that request so other parts of the image may be lost to accommodate that. Where a specific request has been made then these can’t be returned. If we feel that the request will detract from the image then we will get in touch.
